Wood Rogers attorneys, Rich Maxwell and Mark Loftis, are representing the bankruptcy trustee for Peanut Corporation of America. One of the principal accomplishments of this representation is the establishment of a $12,000,000 fund to be used to pay claims resulting from illnesses related to an outbreak of salmonella traced to peanut products sold by Peanut Corporation of America. Woods Rogers achieved this result by negotiating with PCA’s insurer, attorneys representing over 150 injured parties, and manufacturers who had used the peanut products to create a procedure for allowance and payment of salmonella claims. This settlement procedure and the creation of the settlement fund were recently approved by the United States Bankruptcy Court for the Western District of Virginia.
