Paul is Chairman of the Environment and Natural Resources Group at Woods Rogers PLC. He concentrates his practice in the area of environment, health and safety as well as mining and natural resources issues. In addition, based upon his experience as both an Assistant U.S. Attorney and as the U.S. Attorney for the Western District of Virginia as well as the Deputy Assistant Administrator for Criminal Enforcement at USEPA, he also is actively engaged in the “white collar” criminal defense arena. He is a member of the Virginia State Bar , Virginia Bar and American Bar Associations' sections for Environment and Natural Resources and Criminal Law.
Experience
- Defense and crisis management of industrial facility in the wake of a multi-fatality explosion.
- Defense and crisis management of a national natural resources company when a slurry impoundment released several million gallons of material into a stream containing endangered species.
- Defense of municipality charged with the alleged criminal violation of RCRA including the development of community service project to offset the criminal fine.
- Defense of government contractor under the False Claims Act.
- Defense of construction company for alleged criminal violation of Disadvantaged Business Enterprise regulations.
- Defense of criminal violations of the Clean Water Act, and RCRA.
- Successfully represented numerous entities in Suspension and Debarment actions before EPA, Defense Logistics Agency, Department of Agriculture and USDOT.
- Defense of several mining corporations involving alleged criminal violations of the Coal Mine Health and Safety Act.
- Represented large natural resources company in a Natural Resources Damage action.
- Represented buyer in negotiating the first Potential Purchaser Agreement involving an active RCRA correction site.
- Represented a large municipality in the first Audit Agreement entered into in EPA Region III.
- Represented various corporations in defending various civil violations of the Clean Air Act, RCRA, CERCLA and the Clean Water Act.
- Developed Environmental Management Systems, training programs and helped develop environmentally friendly processes for various corporate and municipal entities resulting in savings of time and money.
