Appellate litigation requires more than strong legal arguments. Success often depends on preserving issues at the trial level, understanding complex procedural rules, and presenting a clear, persuasive case on appeal. Our appellate team represents businesses, institutions, government entities, and individuals in state and federal appellate courts, providing strategic guidance from trial through final review.

Woods Rogers attorneys bring substantial appellate experience and a deep understanding of appellate court practice. Many of our lawyers previously served as law clerks to appellate judges, giving them valuable insight into how appellate courts evaluate legal issues and written advocacy. We combine rigorous legal research, analytical precision, and compelling written and oral advocacy to help clients pursue favorable outcomes.

In addition to handling appeals arising from matters tried by our firm, we regularly represent clients in cases where another law firm served as trial counsel. We also work alongside trial teams as appellate consultants, helping preserve issues, develop legal arguments, and position cases for potential appellate review. As embedded appellate counsel, we provide strategic support throughout litigation to strengthen the record and enhance opportunities for success on appeal.

Our team represents clients before the following state and federal appellate courts:

Court of Appeals of Virginia

Virginia law provides a right of appeal in most civil and criminal matters before the Court of Appeals of Virginia. These cases involve significant procedural and substantive requirements. Our attorneys have written on appellate advocacy in the Court of Appeals and have extensive experience litigating before the court.

Supreme Court of Virginia

Parties may seek further review of Court of Appeals decisions by petitioning the Supreme Court of Virginia. Our appellate lawyers regularly represent clients in petitioning for appeal, resisting an appeal, or litigating a granted appeal before the Supreme Court of Virginia. Our lawyers have experience navigating the Supreme Court of Virginia’s procedural requirements.

U.S. Court of Appeals for the Fourth Circuit

The Fourth Circuit reviews appeals from federal district courts in Virginia, Maryland, West Virginia, North Carolina, and South Carolina. Our attorneys regularly represent clients before the Fourth Circuit and are experienced in the Federal Rules of Appellate Procedure and the court's local rules.

U.S. Supreme Court

Appeals from the federal circuit courts like the Fourth Circuit and state supreme courts in certain cases may be considered by the Supreme Court of the United States through the certiorari process. Our team assists clients in pursuing or resisting a petition for a writ of certiorari in the Supreme Court of the United States and stand ready to assist in the event that a petition is granted.
