Brian uses his experience in corporate finance, lending, and related litigation to advise clients on all aspects of bankruptcy, contracts, secured transactions, and restructuring. He has experience with commercial disputes and workouts, with an emphasis on corporate restructuring, bankruptcy, and creditors' rights. His litigation experience includes claims review and analysis, discovery, motions and briefs, workouts, settlement negotiation, alternative dispute resolution, trial, and appeals in federal and state courts.

In addition, Brian’s transaction background providing businesses and lenders with guidance on day-to-day corporate matters like contracts, regulatory compliance, corporate lending and asset purchase agreements, gives him additional valuable insight he uses to understand his clients’ business needs.

Brian served as Judicial Clerk to The Honorable Rebecca B. Connelly, Chief Judge, United States Bankruptcy Court, Western District of Virginia. During law school, he was the Executive Notes & Comments Editor for Jurimetrics: The Journal of Law, Science & Technology, and was awarded the Dean’s Award for Outstanding Performance at the College of Law. Brian keeps abreast of issues in cybersecurity, law, science and technology, and maintains a CIPP/US certification with the International Association of Privacy Professionals (IAPP).

Brian is a mining safety engineer’s son who grew up in Wyoming, Missouri, and South Carolina where he developed a love for all things outdoors. He loves hiking in the Blue Ridge and visiting the National Parks with his wife, Danielle, and their children. When not on the trail on foot, he can be found on his gravel bike, wearing hockey skates, or singing along to an opera or musical.

  • Protected interests of senior lender in $6 million capital project involving hotel conversion to healthcare facility and related foreclosure and bankruptcy litigation in state and federal courts.
  • Settled fiduciary litigation dispute for startup biopharma firm and assisted with mission-critical asset purchase of research portfolio preserving valuable data set to advance to phase 3 trials.
  • Preserved judgment for lender in appeal before Virginia Court of Appeals on $700,000 loan default issue.
  • Represented distressed property developer in multi-property subchapter V reorganization.
  • Served as co-counsel to the Debtors for several large chapter 11 cases, including Intelsat, Le Tote, Alpha Media, Gymboree, & Toys “R” Us with successful reorganizations.
